Tenor
Die Beklagte wird über das Teilanerkenntnisurteil vom 20.6.2013 hinaus verurteilt, an den Kläger weitere 10,00 Euro nebst Zinsen hieraus in Höhe von fünf Prozentpunkten über dem Basiszinssatz der EZB seit dem 31.12.2012 zu zahlen.
Die Beklagte wird weiterhin verurteilt, an den Kläger 41,77 Euro außergerichtliche Kosten der Rechtsverfolgung zu zahlen.
Im Übrigen wird die Klage abgewiesen.
Die Kosten des Rechtsstreits trägt die Beklagte zu 63 % und der Kläger zu 37 %.
Das Urteil ist vorläufig vollstreckbar.
Die Berufung wird nicht zugelassen.
