Tenor

Die Beklagte wird verurteilt, an den Kläger 569,06 € nebst Zinsen in Höhe von 5 Prozentpunkten über dem Basiszinssatz seit dem 28.02.2013 zu zahlen.

Im Übrigen wird die Klage abgewiesen.

Die Kosten des Rechtsstreits trägt die Beklagte.

Das Urteil ist vorläufig vollstreckbar. Der Beklagten bleibt nachgelassen, die Vollstreckung durch Sicherheitsleistung in Höhe von 110 % des aufgrund dieses Urteils vollstreckbaren Betrages abzuwenden, wenn nicht der Kläger vor der Vollstreckung Sicherheit in Höhe von 110 % des jeweils zu vollstreckenden Betrages leistet.

Die Berufung wird zugelassen.
