The District Court of Düsseldorf dismissed the plaintiff's copyright claim against the defendant. The court held that the plaintiff, relying on the retroactive effect of service under § 167 ZPO, had to prove the circumstances making service prompt. Because the last pre-litigation contact was several years old, a diligent claimant should have checked the defendant's address; the failure to do so caused a service delay exceeding one month and defeated retroactive effect. The court also held that a private file-sharer is not enriched by dissemination damage, so recovery on unjust-enrichment grounds was unavailable. Costs were imposed on the plaintiff.

§ 167 ZPO; burden of proof and prompt service in relation to limitation; §§ 102a UrhG, 812(1), 818(1) BGB; enrichment and dissemination damage. The party invoking the retroactive effect of service bears the burden of establishing the facts that make service prompt. Although a claimant is generally not required to verify before filing that the defendant's address remains correct, that rule does not apply without qualification where the last pre-litigation contact dates back several years. In that situation, given the frequency of moves and the absence of a duty on the defendant to report a change of address without recent contact, a diligent claimant may be expected to verify the address. If failure to do so causes delay in service exceeding one month, the retroactive effect does not apply. A private file-sharer is not enriched by dissemination damage and therefore does not owe restitution on that ground.

Spruchkörper: Abteilung 57

Normen: UrhG 97 ZPO 167 BGB852

Leitsätze

The plaintiff did not establish the facts required for service to be considered prompt; retroactive effect did not apply where the resulting delay exceeded one month.

The party relying on § 167 ZPO bears the burden of proving the facts supporting prompt service. When the last pre-litigation contact was several years earlier, a diligent plaintiff could be expected to check the address. Failure to do so that caused a delay exceeding one month precluded retroactive effect.

A private file-sharer is not enriched by the dissemination damage, so no claim on that basis was available.

The defendant's conduct did not result in enrichment for the dissemination damage within the meaning of §§ 102a UrhG, 812(1), and 818(1) BGB.

The claim was dismissed.

The retroactive effect of service was unavailable, and unjust-enrichment recovery for dissemination damage was not established.
