The Federal Court of Justice rejected the complainant’s non-admission complaint against an appellate judgment in a creditor-avoidance case. It held that leasing a farm and forestry business may be an avoidable act under § 1(1) AnfG. In the event of successful avoidance, the creditor may claim the transferred use and benefits, including business profits not attributable to the lessee’s personal performance, under § 11(1) AnfG. However, the court excluded access to individual claims newly arising in the lessee’s name, such as subsidy premiums. The appellate judgment therefore required no review by the revision court.

§ 1 Abs. 1 AnfG, § 11 Abs. 1 AnfG; creditor avoidance and lease of an agricultural and forestry business. A lease of such a business may constitute an avoidable legal act when it effects a disposition of assets within the meaning of creditor avoidance law. Upon successful avoidance, the creditor may claim the fruits and benefits of the leased asset, including business profits, insofar as they are not based on the lessee’s personal labor or skills (consid. 2). By contrast, avoidance does not extend to claims that arise only in the lessee’s person during operation of the business; such claims, including subsidy entitlements, are not assets “given away” by the lessor and are therefore not independently subject to avoidance.

Questione giuridica chiave

Whether the non-admission complaint should succeed and revision be admitted.

Decisione estratta

The complaint was unsuccessful; no reason existed to admit revision.

Motivazione estratta

The appellate judgment was consistent with the law. No fundamental question, need for legal development, or need to secure uniform case law was shown.

Questione giuridica chiave

Whether leasing a farm and forestry business can be an avoidable act under the Creditor Avoidance Act.

Decisione estratta

Yes. Such a lease can constitute an avoidable legal act under § 1(1) AnfG.

Motivazione estratta

The transfer of use and benefits from the debtor’s estate may be an avoidable disposition; however, the later-acquired claims of the lessee are not themselves assets given away by the lessor.

Questione giuridica chiave

Whether subsidy premiums earned by the lessee are recoverable in creditor avoidance.

Decisione estratta

No. The complaint could not reach individual claims newly arising in the lessee’s person, including subsidy premiums.

Motivazione estratta

Creditor avoidance reaches the Nutzungen of the leased asset, including profits from the business only insofar as they are not based on the lessee’s personal performance; it does not extend to newly created claims that did not leave the lessor’s estate.
