Tenor

Die Revisionen der Angeklagten gegen das Urteil des Landgerichts Leipzig vom 23. Januar 2013 werden nach § 349 Abs. 2 StPO als unbegründet verworfen.

Die Beschwerdeführer haben die Kosten ihrer Rechtsmittel zu tragen.

Ergänzend bemerkt der Senat:

  1. Die Beweiswürdigung des Landgerichts ist aus den in der Antragsschrift des Generalbundesanwalts aufgeführten Gründen hinsichtlich beider Angeklagter rechtlich nicht zu beanstanden. Insbesondere entspricht es ständiger Rechtsprechung, dass der Wirkstoffgehalt im Fall der Sicherstellung größerer Betäubungsmittelmengen auf der Grundlage von Stichprobenanalysen geschätzt werden kann (vgl. BGH, Beschluss vom 19. September 2007 – 3 StR 354/07, BGHR BtMG § 29a Abs. 1 Nr. 2 Menge 17). Die Vorgehensweise im vorliegenden Fall unter Zubilligung sehr großzügiger Sicherheitsabschläge weist keine Rechtsfehler zum Nachteil der Angeklagten auf.

  2. Es bestehen bereits durchgreifende Bedenken gegen die Zulässigkeit der durch den Angeklagten C. erhobenen Verfahrensrüge (§ 344 Abs. 2 Satz 2 StPO). Der von der Verteidigung ursprünglich als „bundesweit tätiger und forensisch versierter Gutachter für Stimmenvergleichsgutachten“ bezeichnete, mit der Methode der automatischen Sprechererkennung vertraute, auf den Beweisantrag des Angeklagten von der Strafkammer dann auch vernommene und nach den einschlägigen Richtlinien gutachtende Sachverständige M. hat als einen wesentlichen gegen die Anwendung der Methode sprechenden Umstand angeführt, dass diese bei kurzen Gesprächen (unterhalb von 30 Sekunden) nicht einsetzbar sei (UA S. 39). Vor diesem Hintergrund hätte die Revision die Länge der in der Hauptverhandlung in Augenschein genommenen Gesprächsmitschnitte mitteilen müssen, um dem Senat die Möglichkeit zu eröffnen, gegebenenfalls im Freibeweisverfahren zu klären (vgl. zur Möglichkeit des Freibeweisverfahrens im Revisionsgerichtszug: BGH, Urteile vom 24. November 1992 – 5 StR 500/92, BGHSt 39, 49, 53; vom 29. April 1997 – 1 StR 511/95, BGHSt 43, 66, 72; vom 17. Dezember 1998 – 1 StR 156/98, BGHSt 44, 308, 312 ff.; vom 30. Juli 1999– 1 StR 618/98, BGHSt 45, 164, 166 f.; vom 22. April 2004 – 5 StR 534/02, NStZ-RR 2004, 270, 271; vom 15. Februar 2005 – 1 StR 91/04, StV 2005, 374; Beschluss vom 25. April 2012 – 5 StR 444/11, NJW 2012, 2212, 2213), ob die Methode der automatischen Sprechererkennung nach Art und Länge der Sprechproben und Gesprächsmitschnitte hier anzuwenden gewesen wäre.
