Tenor

Die Anhörungsrüge vom 2. Dezember 2013 gegen das Senatsurteil vom 5. November 2013 wird auf Kosten der Klägerin zurückgewiesen.

Gründe

1 Die gemäß § 321a ZPO statthafte und auch im Übrigen zulässige Gehörsrüge ist nicht begründet.

2 Für die Abwägung zwischen dem Persönlichkeitsschutz der Klägerin und dem Recht der Beklagten auf Freiheit der Berichterstattung spielte zwar der Umstand eine Rolle, dass die Daten der Klägerin in der Öffentlichkeit präsent waren und die Berichterstattung Umstände betraf, die von jedermann mit Hilfe gängiger Systeme problemlos recherchiert werden konnten. Jedoch war für die Abwägung nicht maßgebend, ob sich die Berichterstattung berechtigt auf Äußerungen des Vaters der Klägerin über die Adoption stützen konnte oder dieser tatsächlich andere Informationsquellen zugrunde lagen. Das lässt sich auch den Urteilsgründen entnehmen (Rn. 21).

3 Die Klägerin ist danach nicht in ihrem Anspruch auf rechtliches Gehör verletzt (Art. 103 Abs. 1 GG).
