Tenor

Die Revision des Angeklagten gegen das Urteil des Landgerichts Hannover vom 5. Juli 2013 wird als unbegründet verworfen, da die Nachprüfung des Urteils auf Grund der Revisionsrechtfertigung keinen Rechtsfehler zum Nachteil des Angeklagten ergeben hat (§ 349 Abs. 2 StPO).

Der Beschwerdeführer hat die Kosten des Rechtsmittels und die der Nebenklägerin im Revisionsverfahren entstandenen notwendigen Auslagen zu tragen.

Ergänzend bemerkt der Senat:

Die Rüge der Verletzung des § 229 Abs. 4 Satz 1 StPO bleibt ohne Erfolg. Denn selbst wenn - wie von der Revision geltend gemacht - an den Hauptverhandlungstagen vom 30. Mai 2013 und 7. Juni 2013 nicht zur Sache verhandelt worden wäre, wäre die Unterbrechungsfrist des § 229 Abs. 1 StPO bei Fortsetzung der Hauptverhandlung nicht abgelaufen gewesen. Die Fristen des § 229 StPO stellen keine Fristen im Sinne der §§ 42, 43 StPO dar. Weder der Tag, an dem die Unterbrechung angeordnet wird, noch derjenige, an dem die Verhandlung wieder aufgenommen wird, sind in die Frist einzuberechnen (LR/Becker, StPO, 26. Aufl., § 229 Rn 6). Vor dem 30. Mai 2013 war zuletzt am Donnerstag, den 16. Mai 2013, verhandelt worden, so dass die Unterbrechungsfrist am Freitag, den 17. Mai 2013, zu laufen begann und am Freitag, den 7. Juni 2013, endete. Da der 8. Juni 2013, an dem nach § 229 Abs. 4 Satz 1 StPO die Hauptverhandlung hätte fortgesetzt werden müssen, ein Samstag war, musste nach § 229 Abs. 4 Satz 2 StPO die Hauptverhandlung erst am Montag, den 10. Juni 2013, wieder aufgenommen werden. Dies ist auch geschehen.
