The BGH rejected the defendants' revisions against the LG Essen judgment. It held that the review under § 349 Abs. 2 StPO revealed no error to their detriment. In addition, the Court addressed the adhesion claim concerning defendant O. A.: although personal service of the compensation request could not be proven, the defect was cured because defence counsel with comprehensive service authority had actual knowledge of the request. The Court therefore upheld the adhesion decision by order without oral hearing and ordered the defendants to bear the costs and necessary expenses arising from the appeal.

BGH, Beschluss vom 8. Juli 2009 - 2 StR 239/09, Rn. 4; Beschluss vom 27. September 2007 - 4 StR 324/07, Rn. 5; Beschluss vom 5. Januar 1999 - 3 StR 602/98, NStZ 1999, 260, 261).

Questione giuridica chiave

Whether the defendants' revisions against the LG Essen judgment were well-founded

Decisione estratta

The revisions disclosed no legal error to the defendants' detriment and were rejected as unfounded.

Motivazione estratta

The Court found that review of the judgment on the basis of the statement of grounds did not reveal any reversible error under § 349 Abs. 2 StPO.

Questione giuridica chiave

Whether the compensation request in the adhesion proceedings had been served in time on defendant O. A.

Decisione estratta

A timely compensation request was also made against O. A.; the lack of proof of personal service was cured.

Motivazione estratta

Although no service certificate proved personal service of the out-of-hearing request of 22 January 2013, the defect was cured under § 37 Abs. 1 StPO and § 189 ZPO because the defence counsel with comprehensive service authority had indisputable knowledge of the request through the response of 18 February 2013.

Questione giuridica chiave

Whether the appeal court could decide the adhesion matter without an oral hearing

Decisione estratta

The adhesion decision could be upheld by order without oral hearing.

Motivazione estratta

Since the requirements of § 349 Abs. 2 StPO were met for guilt and sentence, and only the compensation issue remained, § 406 Abs. 5 sentence 2 and § 406a Abs. 2 sentence 2 StPO allowed a decision without oral hearing.

Questione giuridica chiave

Who bears the costs of the remedies and related special expenses

Decisione estratta

The appellants bear the costs of their remedies, the special costs caused by the adhesion proceedings, and the necessary expenses of the private and adhesion claimant in the appeal proceedings.

Motivazione estratta

The costs followed the dismissal of the revisions and the adhesion-related outcome.
