A merely minor partial success does not, by itself, justify a partial allocation of costs to the state under § 473 Abs. 4 StPO; the appellate court may order the appellant to bear the costs in full where no equitable deviation is warranted.

Revision in Strafsachen: Entscheidung des Revisionsgerichts bei Widerspruch zwischen Urteilstenor und Urteilsgründen hinsichtlich des Strafausspruchs
Auf die Revision des Angeklagten wird das Urteil des Landgerichts Stade vom 12. Dezember 2014, soweit es ihn betrifft, im Strafausspruch dahin abgeändert, dass der Angeklagte zu der Gesamtfreiheitsstrafe von einem Jahr und drei Monaten verurteilt wird; die Aussetzung der Vollstreckung zur Bewährung bleibt aufrechterhalten.
Die weitergehende Revision wird verworfen.
Der Angeklagte hat die Kosten seines Rechtsmittels zu tragen.
1 Das Landgericht hat den Angeklagten wegen Betrugs in neun Fällen zu der Gesamtfreiheitsstrafe von einem Jahr und vier Monaten verurteilt und deren Vollstreckung zur Bewährung ausgesetzt. Nach den Urteilsgründen hat es die Gesamtfreiheitsstrafe indes mit einem Jahr und drei Monaten bemessen. Entsprechend dem Antrag des Generalbundesanwalts setzt der Senat deshalb eine Gesamtfreiheitsstrafe von einem Jahr und drei Monaten fest.
2 Das weitergehende Rechtsmittel ist aus den Gründen der Antragsschrift des Generalbundesanwalts unbegründet im Sinne des § 349 Abs. 2 StPO.
3 Der geringe Teilerfolg fordert nicht, die Verfahrenskosten oder die dem Angeklagten entstandenen notwendigen Auslagen teilweise der Staatskasse aufzuerlegen (§ 473 Abs. 4 StPO).
