The Federal Labor Court decided the plaintiff's revision against the judgment of the Saxon Higher Labor Court and rejected it. The appellate judgment therefore remained in force. The court also ordered the plaintiff to bear the costs of the revision proceedings. The decision was issued without a statement of facts and reasons pursuant to the procedural waiver noted in the judgment.
§ 72 Abs. 5 ArbGG, § 555 Abs. 1 Satz 1, § 313a Abs. 1 Satz 2 ZPO; where the parties waive findings of fact and reasons, the Federal Labor Court may decide by judgment without a full statement of reasons. If the revision is dismissed, the revising party bears the costs of the revision proceedings.
