The Federal Labour Court dismissed the plaintiff's revision against the judgment of the Hessian Labour Court in a labor dispute. The court issued its decision without a statement of facts or reasons because the parties, in light of parallel proceedings, waived them. The only operative consequences were dismissal of the revision and allocation of revision costs to the plaintiff.
§ 72 Abs. 5 ArbGG, § 555 Abs. 1 Satz 1 ZPO, § 313a Abs. 1 Satz 2 ZPO; where the parties, in view of parallel proceedings, waive the statement of facts and the reasons, the revision court may render a shortened judgment without factual findings and reasons. The dispositive part alone governs the result; if the revision is dismissed, the appellant bears the costs of the revision.
