The Federal Labor Court dismissed the claimant’s revision against the judgment of the Hessian Regional Labor Court. The court issued the judgment without statement of facts or reasons because the parties had waived them in light of a parallel proceeding. The only operative consequences stated are rejection of the revision and allocation of the costs of the revision to the claimant.
§ 72 Abs. 5 ArbGG; § 555 Abs. 1 Satz 1 ZPO; § 313a Abs. 1 Satz 2 ZPO; revision dismissed and reasons omitted upon waiver of the parties in view of a parallel proceeding. Where the parties validly waive statement of facts and reasons, the Federal Labor Court may decide without reproducing them. If the revision is unsuccessful, the revising party bears the costs of the revision.
