The Federal Labour Court dismissed the plaintiff's revision against the judgment of the Hessian LAG. The court noted that, in light of the parallel case 4 AZR 50/13, the parties had waived findings of fact and reasons. The only operative consequences were dismissal of the revision and allocation of its costs to the plaintiff.
§ 72 Abs. 5 ArbGG; § 555 Abs. 1 Satz 1 ZPO; § 313a Abs. 1 Satz 2 ZPO — If the parties waive findings of fact and reasons in view of a parallel proceeding, the court may render a judgment without factual findings and reasons. The waiver is effective even in revision proceedings; the dismissal of the revision and the consequential cost order remain unaffected by the absence of reasons.
