The Federal Labour Court dismissed the claimant’s revision against the Hessian Regional Labour Court’s judgment. The court ordered the claimant to bear the costs of the revision. The parties had waived a statement of facts and reasons in light of parallel proceedings (4 AZR 50/13).
§ 72 Abs. 5 ArbGG, § 555 Abs. 1 Satz 1 ZPO, § 313a Abs. 1 Satz 2 ZPO; waiver of findings of fact and reasons in revision proceedings. Where the parties waive the statement of facts and reasons, the Federal Labour Court may decide without a full written reasoning if the statutory prerequisites are met, in particular in parallel proceedings. The omission of a detailed recital does not affect the operative part of the judgment; costs are allocated according to the outcome of the revision.
