The Federal Labour Court, 3rd Senate, decided the defendant's revision against the Düsseldorf labour courts' judgments. Because the parties had waived findings of fact and reasoning, the judgment contains only the dispositive part. The Court set aside the appellate judgment, amended the first-instance judgment, dismissed the plaintiff's action, and ordered the plaintiff to bear the costs.
