The Federal Labor Court decided the plaintiff's revision against the Baden-Württemberg Regional Labor Court. The court set aside the appellate judgment and left the Labor Court's decision in force, but clarified that interest on the awarded amount runs only from 4 December 2012. The defendant had to bear the costs of the appeal and revision. The parties had waived a statement of facts and reasons under Section 313a ZPO.
§ 313a ZPO; waiver of statement of facts and reasons. If the parties validly waive the statement of facts and the reasoning, the judgment may be issued without them. On revision, the appellate judgment is to be set aside where the appealed decision cannot be maintained; the appellate appeal may be dismissed with a merely clarifying modification of the interest commencement date. Costs of the appeal and revision follow the outcome and may be imposed on the unsuccessful party.

Auf die Revision des Klägers wird das Urteil des Landesarbeitsgerichts Baden-Württemberg vom 26. November 2014 - 6 Sa 23/14 - aufgehoben.
Die Berufung der Beklagten gegen das Urteil des Arbeitsgerichts Ulm - Kammern Ravensburg - vom 17. Januar 2014 - 6 Ca 234/13 - wird mit der Maßgabe zurückgewiesen, dass Zinsen erst ab dem 4. Dezember 2012 zu zahlen sind.
Die Beklagte hat die Kosten der Berufung und Revision zu tragen.
