The plaintiff challenged the BGH's cost allocation after withdrawing his non-admission appeal, arguing that no valid power of attorney had been signed and that any signature must have been forged. The 5th Civil Senate construed the submission as an objection to the costs order issued on 14 June 2017, but rejected it. It held that a process power granted to a lawyer under § 81 sentence 2 ZPO also authorizes that lawyer to appoint counsel for the higher instances, so the prior lawyer could validly instruct a BGH-admitted attorney to file the non-admission appeal.

A submission contesting a prior costs order is to be treated as a Gegenvorstellung if it seeks reconsideration of that order, but it remains unsuccessful where the underlying process power validly empowered prior counsel to retain higher-instance counsel for the filing of a non-admission appeal. The authorization covers the engagement of a lawyer admitted before the Federal Court of Justice for the higher-instance proceeding (consid. 2).

Die Gegenvorstellung des Klägers gegen die Kostenentscheidung in dem Beschluss des Senats vom 14. Juni 2017 wird zurückgewiesen.
I.
1 Der Senat hat dem Kläger mit Beschluss vom 14. Juni 2017 die Kosten des Beschwerdeverfahrens auferlegt, nachdem dieser die Beschwerde gegen die Nichtzulassung der Revision in dem Urteil des Oberlandesgerichts Köln vom 29. Dezember 2016 zurückgenommen hatte. Mit Schreiben vom 25. Juni 2017 hat der Kläger mitgeteilt, dass er keine Erklärung für die an ihn gerichtete Kostenrechnung des Bundesgerichtshofs vom 22. Juni 2017 habe. Er habe weder eine Vollmacht noch eine Prozessvollmacht unterschrieben. Sollte dem Bundesgerichtshof dennoch eine Unterschrift von ihm vorliegen, sei sie mit Sicherheit gefälscht.

2 Das Schreiben des Klägers ist als Gegenvorstellung gegen die Kostenentscheidung des Senats in dem Beschluss vom 14. Juni 2017 auszulegen. Sie hat keinen Erfolg. Nach § 81 Halbsatz 2 ZPO ermächtigt die einem Anwalt erteilte Prozessvollmacht zur Bestellung eines Prozessbevollmächtigten für die höheren Instanzen (vgl. BGH, Urteil vom 31. Januar 2001 - VIII ZR 142/00, NJW 2001, 1356). Die seitens des Klägers seinem vorinstanzlichen Rechtsanwalt J. V. erteilte Prozessvollmacht berechtigte diesen daher, einen beim Bundesgerichtshof zugelassenen Rechtsanwalt mit der Einlegung einer Nichtzulassungsbeschwerde im Namen des Klägers zu beauftragen.
