Sintesi Omnilex

The Federal Constitutional Court dismissed the election review complaint summarily. The complainant had attacked the 5% second-vote threshold used for distributing Bundestag seats to state lists under § 6(6) sentence 1 alternative 1 BWahlG. The Court held that the threshold is constitutional in light of its established case law and saw no reason to deviate from it. It therefore rejected the complaint without further reasoning under § 24 sentence 2 BVerfGG.

Massima Omnilex

Art. 38 para. 1 sentence 1 GG; § 6(6) sentence 1 alternative 1 BWahlG; summary rejection of an election review complaint: the 5% threshold for taking a party into account in the distribution of Bundestag seats to the state lists is compatible with the Constitution. A complaint raising no arguments capable of overcoming the Court’s settled case law is manifestly unsuccessful and may be rejected without further reasoning under § 24 sentence 2 BVerfGG.

Titelzeile
