The Second Senate’s Third Chamber of the Federal Constitutional Court did not accept the constitutional complaint for decision. The chamber expressly stated that no decision on the reinstatement request was necessary. The decision is final and not subject to appeal.
§ 93d Abs. 1 S. 3 BVerfGG; non-admission of a constitutional complaint by chamber order without reasons. In the simplified chamber procedure, the complaint may be refused acceptance for decision without a substantive statement of reasons; if the complaint is not admitted, ancillary requests such as reinstatement need not be decided upon separately where the main matter is already terminated by non-acceptance. The order is final and not subject to appeal.
