In an abstract norm control procedure, the applicant withdrew the initiating application by brief of 2011-08-30. The Federal Constitutional Court held that the proceedings had to be terminated because no public-interest reasons justified continuation. The case was therefore closed without any substantive review of the challenged norm.

A procedure initiated by an application is to be discontinued once the application is withdrawn, unless continuation is required for reasons of public interest. Such reasons must be specifically present; absent them, the Court does not proceed to a merits review (consid. 1).
