The Federal Constitutional Court did not admit a constitutional complaint against a criminal judgment because it failed to satisfy the statutory substantiation requirements. The submission did not engage in a case-specific, argument-based manner with the challenged judgment under constitutional standards and instead relied on generalities and unsupported accusations. As a result, the request for interim relief also became moot. In addition, the Court imposed a EUR 1,000 misuse fee on the complainants' counsel under § 34(2) BVerfGG because the complaint was manifestly hopeless.

Massima Omnilex

§ 23 Abs. 1 S. 2, § 92 BVerfGG; § 34 Abs. 2 BVerfGG; constitutional complaint inadmissible for lack of substantiated, case-related reasoning; imposition of misuse fee on counsel. A constitutional complaint must, in a manner specific to the challenged decision, engage with the impugned reasoning and demonstrate at least the concrete possibility of a violation of specific constitutional rights. Mere generalities, formulaic assertions, unsupported insinuations, or extraneous allegations do not satisfy the pleading burden. Where the complaint is manifestly inadmissible and objectively hopeless, a misuse fee may be imposed on counsel if the recourse to the Court was recognizably futile (consid. tenor).

Titelzeile

Nichtannahmebeschluss mit Tenorbegründung: Offensichtliche Unzulässigkeit einer unzureichend begründeten Verfassungsbeschwerde - Auferlegung einer Missbrauchsgebühr iHv 1000 Euro zu Lasten des Bevollmächtigten

Tenor

Questione giuridica chiave

Whether the constitutional complaint met the statutory substantiation requirements

Decisione estratta

No. The complaint lacked a sufficiently substantiated, case-specific and argumentative challenge to the impugned judgment under constitutional standards.

Motivazione estratta

The submissions did not show any concrete possibility of a violation of specific constitutional rights; they consisted of generalities, empty phrases, unsupported conspiracy claims, and unsubstantiated allegations.

Questione giuridica chiave

Whether the request for interim relief should still be decided

Decisione estratta

No. It became moot once the constitutional complaint was not admitted.

Motivazione estratta

The interim application was dependent on the main constitutional complaint and therefore lost its basis after non-admission.

Questione giuridica chiave

Whether a misuse fee should be imposed on counsel

Decisione estratta

Yes. A misuse fee of EUR 1,000 was imposed on the complainants' counsel because the filing was manifestly hopeless and devoid of constitutional substance.

Motivazione estratta

The Court found the constitutional complaint obviously inadmissible and the invocation of the Court foreseeably futile for counsel.
