Sintesi Omnilex

In an election complaint under constitutional review, the Federal Constitutional Court held that the complaint of complainant 1 had become moot because she had died during the proceedings. The Court left open whether a successor could continue the case, noting that no successor willing to proceed had been identified by counsel. As to the remaining complaint, the Court rejected it for the reasons already communicated in the rapporteur's letter and, relying on § 24 sentence 2 BVerfGG, gave no further reasons.

Massima Omnilex

§ 24 Satz 2 BVerfGG; election complaint and death of a complainant; the proceedings concerning a deceased complainant are to be declared terminated if no willing successor is designated, while the Court may refrain from further reasoning in case of manifest lack of success. A continuation by a legal successor remains open in principle, but requires that such a successor be identifiable and willing to carry on the complaint. If the Court dismisses a complaint under § 24 sentence 2 BVerfGG, it need not provide additional reasons beyond the cited grounds.
