The Federal Administrative Court granted the complaint and admitted the revision. It held that the case is suitable to clarify the requirements that Article 22(1) of Directive 2003/88/EC imposes on a member-state opt-out rule permitting voluntary additional work in firefighter service beyond 48 hours per week.

Massima Omnilex

§ 132 Abs. 2 Nr. 1 VwGO; admissibility of the revision for fundamental importance in relation to Art. 22(1) of Directive 2003/88/EC. A question is of fundamental importance where the appeal raises a legally significant, previously unresolved issue capable of clarification in the revision proceedings. This is the case where the national requirements for an opt-out rule allowing voluntary overtime in fire service beyond the 48-hour weekly limit under the working-time directive require doctrinal clarification; the revision is then to be admitted (consid. 1).
