Sintesi Omnilex

The Federal Administrative Court upheld the plaintiff’s complaint against the non-admission of revision. It held that the appeal raises a question of fundamental importance: what consequences a breach of the obligation to tender services under an urban-development or development contract has for the development contribution liability of landowners when the municipality allocates the development costs billed by the development agency. The court therefore allowed the revision.

Massima Omnilex

§ 132 Abs. 2 Nr. 1 VwGO; fundamental importance exists where a case raises a clarifiable, general question of law whose answer is relevant beyond the individual dispute. A complaint against non-admission of revision is successful if the contested judgment leaves unresolved the legal consequences of a potentially material breach of a procurement/tendering obligation in the context of passing on development costs under a development contribution scheme. The need for clarification of the interplay between contractual procurement duties and contribution liability may justify admission of revision (consid. 1).
