1 Entgegen der in der Beschwerdebegründung vertretenen Auffassung ist das Landesbeamtenrecht unverändert nach § 127 Nr. 2 BRRG, der nach § 63 Abs. 3 Satz 2 BeamtStG fortgilt, revisibles Recht (vgl. Urteil vom 29. April 2010 - BVerwG 2 C 77.08 - BVerwGE 137, 30 = Buchholz 271 LBeihilfeR Nr. 37, jeweils Rn. 6). Unerheblich ist, dass hier eine Norm des Schulgesetzes und darauf erlassene Verwaltungsvorschriften im Streit stehen. Es kommt allein darauf an, ob die Norm einen beamtenrechtlichen Inhalt hat und deshalb materiell dem Beamtenrecht zuzuordnen ist (dies voraussetzend Urteil vom 26. Juni 2008 - BVerwG 2 C 22.07 - BVerwGE 131, 242 = Buchholz 11 Art. 12 GG Nr. 265; zu den Landespersonalvertretungsgesetzen vgl. Urteile vom 24. Juni 2010 - BVerwG 2 C 15.09 - BVerwGE 137, 192 = Buchholz 235.1 § 55 BDG Nr. 6 Rn. 13 und vom 26. Januar 2012 - BVerwG 2 C 7.11 - Buchholz 237.95 § 208 SHLBG Nr. 1 Rn. 19 jeweils m.w.N.; zu den Landesgleichstellungsgesetzen vgl. Beschluss vom 20. Dezember 2010 - BVerwG 2 B 39.10 - juris Rn. 5).

2 Hiervon ausgehend ist die Revision der Klägerin wegen grundsätzlicher Bedeutung der Rechtssache gemäß § 132 Abs. 2 Nr. 1 VwGO zuzulassen. Das Verfahren bietet Gelegenheit der Frage nachzugehen, ob eine finanzielle Ausgleichsregelung geboten ist, wenn von Lehrern geleistete Vorgriffsstunden aus tatsächlichen Gründen nicht mehr ausgeglichen werden können.

3 Diese Frage wäre selbst dann entscheidungserheblich, wenn die unzutreffende Auffassung des Berufungsgerichts zugrunde gelegt wird, dass es sich bei den Vorgriffsstunden nicht um eine Arbeitszeitregelung handele, sondern um eine nach schleswig-holsteinischem Schulrecht im Organisationsermessen des Schulministeriums stehende nähere Festlegung, in welchem Teil der für alle Beamten geltenden regelmäßigen Wochenarbeitszeit die Lehrer Unterricht zu leisten hätten (vgl. bereits Beschluss vom 15. September 2011 - BVerwG 2 B 33.11 - juris Rn. 6 ff., dort allerdings nicht entscheidungserheblich). Es wird allerdings vorsorglich schon jetzt für das Revisionsverfahren darauf hingewiesen, dass nach der Rechtsprechung des Bundesverwaltungsgerichts die maßgebliche Regelung der Arbeitszeit von Lehrern - dies gilt auch für Lehrer in Schleswig-Holstein - die Pflichtstundenzahl der wöchentlichen Unterrichtsstunden ist. Ihrer Festsetzung liegt die Vorstellung zugrunde, dass sie eine wöchentliche Arbeitszeit im Umfang der allgemein für Beamte angeordneten Arbeitszeit nach sich zieht. Die Pflichtstundenzahlen sind normativ festzulegen; Verwaltungsvorschriften genügen nicht (Urteil vom 30. August 2012 - BVerwG 2 C 23.10 - BVerwGE 144, 93 - LSe 2 und 3 und Rn. 14 f.; zur Notwendigkeit einer normativen Festlegung insoweit in Abkehr zur früheren Rechtsprechung).
