The Federal Administrative Court held that Schleswig-Holstein civil service law remains revisable federal law if the disputed norm has a substantive civil-service character. It therefore admitted the revision because the case raises a question of fundamental importance: whether teachers must receive financial compensation when advance teaching hours cannot later be balanced out. The court also indicated for the merits that a teacher’s working time is determined by the compulsory teaching-hour quota and that such quotas require a normative basis, not merely administrative instructions.

§ 127 Nr. 2 BRRG i.V.m. § 63 Abs. 3 Satz 2 BeamtStG; revisibility of Land civil-service law and admissibility of revision for fundamental importance: A Land norm is revisable federal law if, by its subject matter, it is materially attributable to civil-service law; it is immaterial that the dispute is also framed by school-law provisions or administrative instructions. For teachers, the decisive working-time norm is the compulsory teaching-hour quota, which is premised on a corresponding weekly working-time obligation for all civil servants; such quotas must be set normatively and cannot be replaced by mere administrative directives (consid. 1, 3). The question whether a financial compensation mechanism is required where advance hours cannot later be offset is capable of justifying admission of the revision under § 132(2) No. 1 VwGO (consid. 2).
