Sintesi Omnilex

The Federal Administrative Court granted the defendant leave to appeal against a Saxon Higher Administrative Court judgment. The lower court had held that house plots which do not themselves satisfy Section 64 LAnpG generally cannot be included in a land reorganization procedure because they lack a reorganization interest under Section 53(1) LAnpG. The court found a divergence from its own 2002 precedent, which allows inclusion of such parcels when this is necessary for a workable solution to the underlying property-law conflict, including access considerations. The dispute value was fixed under the Court Costs Act.

Massima Omnilex

§ 132 Abs. 2 Nr. 2 VwGO; divergence justifying admission of revision exists where the appealed judgment formulates a legal proposition that conflicts with a decisive abstract proposition of the Federal Administrative Court. In land reorganization proceedings under the LAnpG, parcels need not themselves satisfy the requirements of § 64 LAnpG in order to be included in the procedural area if, without their inclusion, a sensible solution to the underlying real-property conflict cannot be achieved, particularly where access or similar functional considerations require inclusion (cf. 2002 precedent).

Questione giuridica chiave

Whether revision should be admitted for divergence under Section 132(2) No. 2 VwGO

Decisione estratta

Yes. The appealed judgment departed from the Federal Administrative Court's earlier case law on inclusion of parcels in land reorganization proceedings.

Motivazione estratta

The lower court adopted a legal proposition that house plots not meeting Section 64 LAnpG requirements cannot in principle be included because they lack an interest in reorganization. That conflicts with the Federal Administrative Court's 2002 precedent allowing inclusion of parcels that do not themselves satisfy Section 64 LAnpG where this is necessary for a sensible resolution of the underlying property-law conflict, for example for access purposes.
