PER CURIAM:
Curtis Watson petitions for a writ of mandamus, alleging that the magistrate judge
has unduly delayed in issuing a report and recommendation on Watson’s 28 U.S.C. § 2255
motion and in ruling on his related motion for release. Watson seeks an order from this
court directing the magistrate judge to act. Our review of the district court’s docket reveals
that the magistrate judge filed his report and recommendation. Accordingly, because the
magistrate judge took significant action on Watson’s § 2255 motion and other pending
motions, we deny the mandamus petition as moot. We dispense with oral argument
because the facts and legal contentions are adequately presented in the materials before this
court and argument would not aid the decisional process.
PETITION DENIED
