I. INTRODUCTION
Before the Court is Plaintiffs Operating Engineers’ Health and Welfare Trust Fund for Northern
California, et al.’s (“Plaintiffs” or “Trust Funds”) Motion for Order to Show Cause Why Defendants
Capurro AG Solutions, LLC and Weston K. Capurro (hereinafter collectively, “Defendants”) Should
Not Be Held in Contempt and for Monetary Sanctions. Dkt. No. 44 (the “OSC Motion”).

appear at the OSC hearing and have continued to disobey this Court’s orders.
Having considered the record, including Plaintiffs’ submissions, the Court’s prior orders, and

sanctions as set forth below.

III. LEGAL STANDARD
“Civil contempt [] consists of a party’s disobedience to a specific and definite court order by
failure to take all reasonable steps within the party’s power to comply.” Reno Air Racing Ass’n, Inc. v.
McCord, 452 F.3d 1126, 1130 (9th Cir. 2006) (quotation omitted). “The standard for finding a party
in civil contempt is well settled: The moving party has the burden of showing by clear and convincing
evidence that the contemnors violated a specific and definite order of the court.” In re Bennett, 298
F.3d 1059, 1069 (9th Cir. 2002) (internal quotation and citation omitted). Once the moving party does
so, the “burden then shifts to the contemnors to demonstrate why they were unable to comply.” Id.
(quotation omitted)
Plaintiffs may “recover attorney’s fees and costs incurred in bringing and prosecuting . . .
contempt proceedings.” Inst. of Cetacean Research v. Sea Sheperd Conservation Soc’y, 774 F.3d 935,
958 (9th Cir. 2014). The “cost of bringing the violation to the attention of the court is part of the
damages suffered by the prevailing party and those costs would reduce any benefits gained by the
prevailing party from the court’s violated order.” Id. (citing Perry v. O’Donnell, 759 F.2d 702, 705
(9th Cir. 1985)) (quotation omitted).
IV. DISCUSSION
A. The Court has authority to impose sanctions against Defendants for failure to
comply with the judgment.
A federal district court has the authority to impose monetary sanctions against a defendant who
disobeys a court order. As the Ninth Circuit has explained:
Civil contempt occurs when a party fails to comply with a court

order. Failure to comply need not be
intentional.
General Signal Corp. v. Donallco, Inc., 787 F.2d 1376, 1379 (9th Cir. 1986) (citations omitted).
“Sanctions for civil contempt may be imposed to coerce obedience to a court order, or to compensate
the party pursuing the contempt action for injuries resulting from the contemptuous behavior, or both.”
Id. at 1380. The Ninth Circuit has further explained:
The power of courts to punish for contempts is a necessary and
integral part of the independence of the judiciary, and is absolutely
essential to the performance of duties imposed on them by law.
See Inst. Of Cetacean Research, 774 F.3d at 957–58.
Sanctions for contempt may also include the award of attorneys’ fees and costs incurred in
bringing such a motion for contempt. Id. at 958–59; see also Parsons v. Ryan, 949 F.3d 443, 455–56
(9th Cir. 2020) (confirming district court’s inherent authority to issue civil contempt orders and
sanctions for violations of a court order, provided they are “coercive” or “compensatory” instead of
“punitive”).
Further, a court may hold an officer of a defendant corporation in contempt of court for the
corporation’s failure to comply with a court order because an officer of the corporation is the one
responsible for the corporation’s affairs, and thus is subject to the court’s order just as the corporation
itself is. Cf. Vasquez v. Libre by Nexus, Inc., 2023 WL 360242, at *10–11 (N.D. Cal. Jan. 23, 2023)
(finding non-party corporate officers in civil contempt for company conduct).
B. Defendants failed to comply with the Judgment and have disobeyed the Court’s
orders.
Pursuant to this Court’s January 11, 2024, Judgment, Defendants were ordered to submit to an
audit of their books and records, including all outstanding contribution reports, covering the period of
April 1, 2020, through August 31, 2023. Dkt. No. 40. In addition, pursuant to the Court’s January 11,
2024, Judgment, Defendants were ordered to pay Plaintiffs the sum of attorneys’ fees and costs in the

total amount of $18,328.71 ($15,080.00 for attorneys’ fees and $3,248.71 in costs). See. Dkt. No. 40.
As explained above, Defendants have failed to respond, comply with the audit, submit their
outstanding contribution reports, and pay the attorneys’ fees and costs as ordered by the Court. See Dkt.
No. 45 and Exhibit A attached thereto.
In addition, since the Court’s January 26, 2026, Order Granting Plaintiffs OSC Motion (Dkt.
No. 51) and February 19, 2026, hearing, Defendants:
• Failed to attend any of the scheduled and noticed hearings;
• Failed to provide the required audit documents despite deadlines;
• Failed to make promised payments to Plaintiffs;
• Failed to provide proof of any payment; and
• Ceased responding to Plaintiffs’ communications.
Defendants’ repeated failure to comply, despite notice, opportunity, and Defendants’
representations of forthcoming compliance, constitutes disobedience of the Court’s orders.
C. Plaintiffs are awarded their requested attorneys’ fees.
Plaintiffs’ OSC Motion requests an award of their attorneys’ fees and costs in bringing their
OSC Motion. Dkt. No. 44 at 4. ERISA § 502(g)(2) requires the Court to award Plaintiffs “reasonable
attorney’s fees and costs of the action” when Plaintiffs obtain a judgment in their favor or otherwise
obtain the relief sought. Nw. Adm’rs., Inc. v. Albertson’s, Inc., 104 F.3d 253, 258 (9th Cir. 1996) (citing
29 U.S.C § 1132(g)(2)) (noting provision is “mandatory, not discretionary”). Similarly, the Bargaining
and Trust Agreements provide that Defendants must pay all reasonable attorneys’ fees and costs
incurred in relation to the collection of delinquent contributions.
Here, Plaintiffs’ Motion for Default Judgement was granted in part, see Dkt. No. 39, requiring
that Defendants comply with the audit and pay Plaintiffs’ attorneys fees and costs in the total amount
of $18,328.71, see Dkt. No. 40.
Given Defendants’ failure to comply with the Judgment, Plaintiffs filed their OSC Motion
seeking a total of $3,416.00 in attorneys’ fees for the time involved in drafting their OSC Motion
representing the time from March 22, 2024, through May 31, 2024. See Dkt. No. 45 at ¶¶ 13–17, &

Based on the record to date, including Defendants’ disobedience of all Court orders, Defendants
