By Order (Doc . 57) entered August 12, 2026, the Court ordered prose P laintiff to file
evidence of executed P rocess R ecei pt and R eturn or waiver with respect to Ry an Zellner
and/ or show cause no later than Friday, August 28, 2026, why the Complaint should not be
dismissed as to D efendant Ryan Zellner for failure to serve such D efendant. Plai ntiff's
R esponse (Doc . 59) to the August 12, 2026 Order was filed August 13, 2026. TI1erein, P laintiff
states that he has not received an executed P rocess R eceipt and R eturn or waiv er with respect
to servi ce on Ryan Zellner and is unaware of the status of service through the U nited States
Marshals Service for the Middle D istrict of G eorgia (" Marshals Service") .
The Court has since been informed that , due to lack of personnel , the Marshals Service
inadv ertently fail ed to process the J une 23, 2026 USM 285 P rocess R ecei pt and R eturn, and
such P rocess R eceipt and R eturn was processed on August 12, 2026 via Federal Express
service . T hus , the Court accepts Plai ntiff's explanation and finds no sanction or further action
as to Plai ntiff is appropriate at this time. H owev er , tl1e Court reminds P laintiff that it is his
responsibility to monitor and inquire regarding the status of servi ce to ensure its timeliness
and/ or to take tl1e necessary steps to ensure that servi ce is completed as ordered.

B ased on the foregoing, the Court DIRECTS the Marshals Service to promptly
complete service on R yan Zellner and provide notice of such service to P laintiff and this
Court.
