AN ACT
Relating to marriage; and amending, revising, consolidating and changing the law relating thereto.
Compiler's Note: Section 6(a) of Act 206 of 1990, which enacted the Domestic Relations Code (23 Pa.C.S.), repealed Act 383.
Compiler's Note: Section 19 of Act 383 was amended during the 1990 session of the General Assembly and there is some question as to whether this amendment is to be given effect. Accordingly, this section is set forth with a compiler's note indicating its probable disposition and status.
Section 19. Fees.--The fee to be charged by the clerk of the orphans' court in various counties for issuing a marriage license or declaration and for returns thereof to the Department of Health shall be thirteen dollars, two dollars and fifty cents of which shall be for the use of the clerk of the orphans' court of the county wherein such license is issued, and fifty cents for the use of the Commonwealth plus ten dollars, which shall be in addition to the cost of the marriage license, to be forwarded to the Department of Public Welfare for use for victims of domestic violence in accordance with the provisions of section 2333 of the act of April 9, 1929 (P.L.177, No.175), known as "The Administrative Code of 1929." In addition, the clerk shall make the usual charge for affidavits. All monies collected by the said clerk for the use of the Commonwealth shall, on or before the tenth day of the following month, be transmitted to the State Treasurer, to be placed in the General Fund for the use of the Commonwealth. The Commonwealth shall certify that such monies will not be used to supplant Federal and State funds otherwise available for domestic violence services.
(19 added Dec. 20, 1990, P.L.1471, No.222)
Compiler's Note: The Department of Public Welfare, referred to in this section, was redesignated as the Department of Human Services by Act 132 of 2014.
Compiler's Note: Section 19 was also repealed December 19, 1990, P.L.1240, No.206, as a result of the repeal of the entire Marriage Law of 1953, but the text is still carried because the section is effective under 1 Pa.C.S. § 1952 (relating to effect of separate amendments on code provisions enacted by same General Assembly) as a result of the 1990 amendment.
