The Obergericht stated that when a case is continued before a new judge, the parties must be informed of the change so that they can raise objections, including recusal requests, and ask for repetition of the hearing or evidence-taking if special reasons exist. It further held that actions against judges or officials alleging violation of personality rights through official acts are inadmissible, because the remedies against judicial and official decisions are exhaustively regulated by statute. A constitutional complaint against this approach was dismissed in 1977.

The legal remedies provided by the procedural statutes against judicial and official decisions are exhaustive; a separate action alleging infringement of personality rights by such an act is therefore excluded and must be rejected as inadmissible. Conversely, where a case is continued before a different judge without a renewed hearing, the parties must be notified of the change so that they may invoke recusation grounds and, where special reasons are shown, request repetition of the hearing or of evidentiary acts (consid. 1-2).

Gerichtsentscheide 3081,3082 träge der beklagten Partei sind summarisch aufzunehmen, wenn ein neuer Richterohne weitere Verhandlung informiert werden soll. - Die Par­teien sind über den Richterwechsel zu informieren, damit sie allfällige Ein­wendungen (Ablehnungsbegehren gegen die neuen Richter) und beson­dere Gründe für die Wiederholung der Verhandlung oder Beweisabnahme Vorbringen können. Klagen gegen Beamte und Behördemit­glieder wegen Verletzung der Persönlichkeitsrechte bei Ausübung einer Amtshandlung. «Es ist kürzlich wiederholt vorgekommen, dass eine unterlegene Partei ein Gericht oder einen Richter einklagten mit der Begründung, durch einen Entscheid oder eine Amtshandlung sei sie in ihren Persönlichkeitsrechten verletzt worden (Art. 28 ZGB). Die eidgenössischen und kantonalen Gesetze (ZPO, StPO, SchKG; OG und BStP für das Verfahren vor Bundesgericht) ordnen die Rechtsmittel gegen die Entscheide und Amtshandlungen von Gerichten, weiteren Kol­legialbehörden und einzelnen Amtspersonen abschliessend. Damit bleibt kein Raum, diese Behörden oder Amtspersonen einzuklagen mit der Be­gründung, das Persönlichkeitsrecht des Betroffenen sei durch einen Ent­scheid verletzt worden. Als Aufsichtsbehörde über die Rechtspflege weisen wir Sie daher an, solche Klagen als unzulässig zurückzuweisen. Bei Ungewissheit überden Klagegrund ist der Kläger aufzufordern, sein Rechtsbegehren zu be­gründen.» Eine hiegegen erhobene staatsrechtliche Beschwerde wurde am 18. März 1977 abgewiesen.
