The case concerned a challenge to a Buochs communal resolution alleged to breach Sunday law by banning communal meetings during and after worship services. The complainants brought the matter before the Federal Court. The Court held that jurisdiction over disputes relating to Arts. 49-51 of the Federal Constitution was reserved to the Federal Council and, where applicable, the Federal Assembly. It therefore found that it was not competent to decide the complaint and declined to enter into the merits.
