The Aargau Higher Court fixed attorney fees at CHF 217 in a moderation dispute involving the cessionary of the appellant and the heirs of Albin Oschger. Dr. Gäng sought to have the cantonal judgment annulled for allegedly applying the abolished Aargau tariff instead of federal obligations law. The Federal Court held that, because the complaint targeted the use of cantonal rather than federal law, the proper remedy would have been cassation, not appeal. It also noted that the submission was lodged after the applicable time limit. The court therefore did not enter into the matter.

A party who complains that a cantonal authority applied cantonal law instead of federal law cannot use the ordinary federal appeal where the statute requires another remedy; the incorrect choice of remedy is fatal to admissibility. In addition, the extraordinary complaint mechanism under Art. 182 OG is subject to a strict sixty-day period, which must be observed; expiry of the term leads to non-entry irrespective of the merits. The Federal Court examines admissibility ex officio and refuses to hear filings that are both procedurally misdirected and out of time.

  1. Urteil vom 16. März 1894 in Sachen Gäng. Am 12. Dezember 1893 erkannte das Obergericht des Kantons Aargau in einer Moderationssache des Notars Schraner in Stein, als Cessionär des heutigen Rekurrenten, gegen Albin Oschgers Erben, es seien die an erstern zu zahlenden Anwaltsdeserviten auf 217 Fr. festgesetzt. Gegen dieses am 3. Januar 1894 mit geteilte Erkenntnis erklärte Dr. Gäng am 6. März 1894 den Rekurs an das Bundesgericht mit dem Begehren, dieses wolle das Urteil des aargauischen Obergerichtes wegen Verletzung der Vor schriften des eidgenössischen Obligationenrechtes aufheben und das selbe anweisen, im Sinne der Ausführungen des Rekurses zu urteilen, unter Kostenfolge. Im Rekurs wird wesentlich ausgeführt, daß das Obergericht mit Unrecht statt des XIV. Titels des eid genössischen Obligationenrechts den durch dasselbe abgeschafften aargauischen Anwaltstarif vom Jahre 1892 zur Anwendung gebracht habe; sofern genannter Tarif überhaupt noch Gesetzes kraft habe, bestimme er nur, welche Kosten der obsiegenden Partei vom Gegner zu ersetzen seien. Das Bundesgericht zieht in Erwägung: Da Rekurrent sich darüber beschwert, es sei in casu kan tonales Recht an Stelle des eidgenössischen angewendet worden, so hätte angesichts der Unzuläßigkeit der Berufung gemäß Art. 89 O. G. das Rechtsmittel der Kassation ergriffen werden sollen. Das ist nun nicht geschehen, sondern vielmehr die zwanzig tägige Frist des Art. 90 gl. Ges. unbenützt verstrichen und hat darauf Fürsprech Gäng hierorts eine Einlage eingereicht, die er als Rekurs betitelt. Nun ist aber, von einer hier nicht zutreffenden Ausnahme abgesehen, gemäß Art. 182 O. G. wegen Verletzung privatrechtlicher Vorschriften des eidgenössischen Rechts durch Ent scheide von Kantonsbehörden eine staatsrechtliche Beschwerde beim Bundesgerichte nicht zuläßig, und ist zu alledem auch die sechzig tägige Frist zur Erhebung derselben nicht eingehalten worden. In der Tat fand die Mitteilung der angefochtenen Entscheidung am
  2. Januar 1894 statt, während der Rekurs erst am 6. März 1894 der Post übergeben wurde. Demnach hat das Bundesgericht erkannt: Auf den Rekurs wird im Sinne der Erwägungen nicht ein getreten.
