Resumo Omnilex

The complainant sought federal review of a cantonal decision rejecting his recusal request against Prosecutor Thomas Weltert. The Federal Supreme Court held that the filing did not satisfy the substantiation requirements because it did not show why the challenged reasoning or outcome was unlawful or unconstitutional. The defect was obvious and the court therefore decided the matter in simplified procedure. The complaint was not entered into, and, exceptionally, no court costs were imposed.

Sumário Omnilex

Art. 42 Abs. 2 and Art. 106 Abs. 2 BGG; substantiation of a complaint in criminal matters: the appellant must, in a reasoned manner, show why the contested decision infringes federal law or constitutional rights. A merely appellatory submission that does not engage with the decisive reasoning is inadmissible. Where the deficiency is manifest, the Federal Supreme Court may decide in simplified procedure under Art. 108 Abs. 1 BGG. In exceptional circumstances, costs may be waived under Art. 66 Abs. 1 BGG (consid. 1).

Urteil 3. Juni 2009
I. öffentlich-rechtliche Abteilung

Besetzung
Bundesrichter Féraud, Präsident,
Gerichtsschreiber Bopp.

Parteien
X.________, Beschwerdeführer,

gegen

Staatsanwalt Thomas Weltert, Untersuchungsamt Uznach, Grynaustrasse 3, 8730 Uznach.

Gegenstand
Ausstand,

Beschwerde gegen den Entscheid vom 27. April 2009
des Präsidenten der Anklagekammer des
Kantons St. Gallen.
In Erwägung,
dass X.________ mit Eingabe vom 27. Mai (Postaufgabe: 28. Mai) 2009 gegen einen am 27. April 2009 in Bezug auf sein gegen Staatsanwalt Weltert gerichtetes Ausstandsbegehren ergangenen Entscheid des Präsidenten der Anklagekammer des Kantons St. Gallen der Sache nach Beschwerde in Strafsachen (Art. 78 ff. BGG) ans Bundesgericht erhoben hat;
dass er nicht darlegt, inwiefern die dem Entscheid zugrunde liegende Begründung bzw. der Entscheid im Ergebnis rechts- bzw. verfassungswidrig sein soll;
dass die Beschwerde somit den gesetzlichen Formerfordernissen (Art. 42 Abs. 2 und Art. 106 Abs. 2 BGG, s. in diesem Zusammenhang BGE 134 II 349 E. 3 S. 351 f. sowie 133 II 249 insb. E. 1.4 S. 254), auf die der Beschwerdeführer bereits in einem früheren Verfahren aufmerksam bemacht worden ist (s. Urteil 1B_150/2007 vom 9. August 2007), nicht zu genügen vermag;
dass daher schon aus diesem Grund auf die Beschwerde nicht einzutreten ist;
dass der genannte Mangel offensichtlich ist, weshalb über die Beschwerde im vereinfachten Verfahren nach Art. 108 Abs. 1 BGG entschieden werden kann;
dass es sich bei den gegebenen Verhältnissen rechtfertigt, ausnahmsweise keine Kosten zu erheben (s. Art. 66 Abs. 1 BGG);

erkennt der Präsident:

1.
Auf die Beschwerde wird nicht eingetreten.

2.
Es werden keine Kosten erhoben.

3.
Dieses Urteil wird dem Beschwerdeführer, dem Staatsanwalt Thomas Weltert sowie dem Präsidenten der Anklagekammer des Kantons St. Gallen schriftlich mitgeteilt.
