Resumo Omnilex

X. appealed to the Federal Supreme Court against a Zurich detention judge’s order transferring his release request to the public prosecutor for further treatment. The Court held that the challenged order was not itself a detention decision and that the appellant failed to substantiate any violation of federal or constitutional law. The complaint did not satisfy the reasoning requirements, so the Court did not enter into it. Given the circumstances, no court costs were imposed.

Sumário Omnilex

Art. 42(2) and Art. 106 BGG; admissibility of a complaint against a procedural transfer order: A referral order by which a detention judge forwards a release request to the prosecutor for further handling does not yet constitute an appealable detention decision. A complaint against such an order must specifically and substantiatedly demonstrate why it is contrary to federal or constitutional law; absent such reasoning, the Federal Supreme Court will not enter into the matter. In appropriate circumstances, no costs may be charged.

Bezirksgericht Zürich, Haftrichter, Wengistrasse 28, Postfach, 8026 Zürich.

Gegenstand
Haftentlassung,

Beschwerde gegen die Verfügung des Bezirksgerichts Zürich, Haftrichter, vom 25. Oktober 2007.

In Erwägung:
dass der Haftrichter des Bezirksgerichts Zürich mit Verfügung vom 25. Oktober 2007 ein von X.________ am 23. Oktober 2007 gestelltes Haftentlassungsgesuch in Anwendung von § 64 Abs. 2 StPO/ZH und § 194 Abs. 2 GVG/ZH der Staatsanwaltschaft III des Kantons Zürich zur weiteren Behandlung überwiesen hat;

dass X.________ gegen diese Verfügung der Sache nach Beschwerde in Strafsachen erhoben hat;

dass es sich bei der angefochtenen Überweisungsverfügung nicht bereits um einen Haftentscheid handelt;

dass der Beschwerdeführer nicht darlegt, inwiefern diese Überweisungsverfügung rechts- bzw. verfassungswidrig sein soll;

Questão jurídica principal

Whether the transfer order concerning the detention release request is an appealable detention decision.

Decisão extraída

The challenged order was not yet a detention decision and therefore could not be reviewed as such.

Fundamentação extraída

The Federal Supreme Court held that the transfer of the release request to the prosecution for further treatment was only a procedural referral order. The appellant did not show any violation of federal or constitutional law, so the appeal failed to meet the formal requirements.

Questão jurídica principal

Whether the appeal met the formal pleading requirements under the Federal Supreme Court Act.

Decisão extraída

No. The appeal did not sufficiently explain why the transfer order would be unlawful or unconstitutional.

Fundamentação extraída

Because the complaint lacked substantiated reasoning under Art. 42(2) BGG and Art. 106 BGG, the Court could not examine it on the merits.
