Resumo Omnilex

X.________ and Y.________ requested revision of a Federal Supreme Court judgment of 21 August 2012 that had not entered into their earlier complaint. The court held that a final judgment can be altered only on a statutory revision ground, but the filing of 19 September 2012 did not identify any such ground. Without exchanging written submissions, the court declared the revision request inadmissible. It also waived court costs.

Sumário Omnilex

Art. 121 ff. BGG; revision of a final Federal Supreme Court judgment is admissible only if the applicant invokes and substantiates a statutory ground for revision. A mere request for rehearing or a general demand for reconsideration does not suffice. If no revision ground is apparent from the application, the court may refuse to enter into the matter without a written exchange under Art. 127 BGG. Court costs may be waived pursuant to Art. 66 Abs. 1 BGG.

Gegenstand
Verwaltungsgericht des Kantons Zürich.

Revisionsgesuch gegen das bundesgerichtliche
Urteil 1C_375/2012 vom 21. August 2012.

In Erwägung,
dass das Bundesgericht mit Urteil vom 21. August 2012 wegen offensichtlich verspäteter Beschwerdeeinreichung bzw. mangels einer hinreichenden Begründung im Sinne von Art. 42 Abs. 2 BGG auf eine Beschwerde von X.________ und Y.________ nicht eingetreten ist (1C_375/2012);
dass sich X.________ und Y.________ mit Eingabe vom 19. September 2012 ans Bundesgericht gewandt und um "Neubeurteilung des Urteils vom 21. August 2012" ersucht haben;
dass die Aufhebung oder Abänderung eines in Rechtskraft erwachsenen Bundesgerichtsurteils nur bei Vorliegen eines Revisionsgrundes gemäss Art. 121 ff. BGG möglich ist;
dass sich aus der Eingabe vom 19. September 2012 nicht ergibt, inwiefern das bundesgerichtliche Urteil vom 21. August 2012 an einem Revisionsgrund leiden sollte;
dass ohne Schriftenwechsel (Art. 127 BGG) auf das Revisionsgesuch nicht einzutreten ist;
dass auf eine Kostenauflage verzichtet werden kann (Art. 66 Abs. 1 BGG);

erkennt das Bundesgericht:

1.
Auf das Revisionsgesuch wird nicht eingetreten.

2.
Es werden keine Kosten erhoben.

3.
Dieses Urteil wird den Parteien, der Planungs- und Baukommission der Gemeinde Thalwil und dem Verwaltungsgericht des Kantons Zürich, 1. Abteilung, 1. Kammer, schriftlich mitgeteilt.

Questão jurídica principal

Whether the request for revision of judgment 1C_375/2012 was admissible

Decisão extraída

The revision request was inadmissible because the submission of 19 September 2012 did not show any revision ground under the Federal Supreme Court Act.

Fundamentação extraída

A final Federal Supreme Court judgment may be altered only if a statutory ground for revision exists. The applicants' filing merely requested a new assessment and did not explain any such ground; therefore the court could not enter into the matter without exchanging written submissions.

Questão jurídica principal

Whether court costs should be charged

Decisão extraída

No court costs were imposed.

Fundamentação extraída

Given the inadmissibility of the revision request, the court exercised its discretion to waive costs under Article 66(1) BGG.
