Resumo Omnilex

X. requested revision of a Federal Supreme Court judgment that had not entered his earlier complaint. He relied on Art. 121 lit. d BGG and argued that the Court had overlooked that the Kantonsrat, not the Obergericht, was competent in the authorization procedure against three Kantonsspital Winterthur employees. The Court held that this was a legal argument, not an overlooked fact, and that criticism of legal reasoning is not admissible in revision. It therefore declined to enter the revision request and charged court costs of CHF 500 to the applicant.

Sumário Omnilex

Art. 121 lit. d BGG; revision only for overlooked facts in the file, not for criticism of legal assessment. A request based on the contention that the court misjudged competence or applied the law incorrectly does not satisfy the revision ground of overlooked facts. In revision proceedings, review of the correctness of the legal reasoning is excluded; only factual oversights of substantial relevance may be invoked (consid. 1). Where the asserted error concerns competence under cantonal law, this is a legal issue and cannot be remedied by revision. Court costs are borne by the unsuccessful applicant under Art. 66 Abs. 1 BGG.

Oberstaatsanwaltschaft des Kantons Zürich, Florhofgasse 2, Postfach, 8090 Zürich,
Obergericht des Kantons Zürich, III. Strafkammer,

Gegenstand
Revisionsgesuch gegen das Urteil des Schweizerischen Bundesgericht 1C_313/2013 vom 21. März 2013.

In Erwägung,
dass das Bundesgericht mit Urteil vom 21. März 2013 (1C_313/2013) mangels einer hinreichenden Begründung im Sinne von Art. 42 Abs. 2 BGG auf eine Beschwerde von X.________ nicht eingetreten ist;
dass X.________ mit Eingabe vom 19. August 2013 um Revision des bundesgerichtlichen Urteils 1C_313/2013 vom 21. März 2013 ersucht hat;
dass sich der Gesuchsteller auf den Revisionsgrund von Art. 121 lit. d BGG beruft, wonach das Gericht in den Akten liegende erhebliche Tatsachen aus Versehen nicht berücksichtigt habe;
dass er dabei geltend macht, das Bundesgericht habe die "Tatsache" übersehen, dass für das Ermächtigungsverfahren gegen die drei Mitarbeiter des Kantonsspitals Winterthur nicht das Obergericht, sondern der Kantonsrat zuständig sei;
dass sich die Kritik des Gesuchsstellers nicht auf eine Tatsachenfeststellung, sondern auf einen Rechtsstandpunkt bezieht;
dass Kritik an der rechtlichen Würdigung im Revisionsverfahren nicht zu hören ist;
dass im Übrigen die Zuständigkeit des Obergerichts gegeben ist (vgl. § 148 GOG);
dass ohne Schriftenwechsel (Art. 127 BGG) auf das Revisionsgesuch nicht einzutreten ist;
dass die Gerichtskosten entsprechend dem Verfahrensausgang dem Gesuchsteller aufzuerlegen sind (Art. 66 Abs. 1 BGG);

erkennt das Bundesgericht:

1.

Auf das Revisionsgesuch wird nicht eingetreten.

2.

Die Gerichtskosten von Fr. 500.-- werden dem Gesuchsteller auferlegt.

3.

Dieses Urteil wird den Parteien, der Staatsanwaltschaft I des Kantons Zürich, der Oberstaatsanwaltschaft des Kantons Zürich und dem Obergericht des Kantons Zürich, III. Strafkammer, schriftlich mitgeteilt.
