Resumo Omnilex

X. filed a constitutional complaint against a judgment of the Zurich cantonal criminal chamber. The Federal Court held that the complaint was filed too late because the filing date and the finality certificate showed that the cantonal judgment had long since become final. It therefore refused to enter into the complaint. Exceptionally, it waived court costs.

Sumário Omnilex

Art. 89 Abs. 1 OG; timeliness of a staatsrechtliche Beschwerde and consequences of late filing. A constitutional complaint must be lodged within 30 days from service of the cantonal decision as determined by cantonal law. If the complainant does not establish the date of service, and the record indicates that the decision has already entered into force, the Federal Court may infer untimeliness and decline to enter. In such a case, costs may exceptionally be waived under Art. 36a OG.
