Resumo Omnilex

A claimant sought CHF 250,000 in state-liability damages against the Canton of Zurich. The district court refused to enter into the case because the advance payment was not made. The cantonal appellate court also refused to enter into the appeal because it lacked any substantive reasoning against the district court's grounds. The Federal Supreme Court held that the federal complaint likewise failed to address the decisive reasons of the cantonal decision and was therefore manifestly insufficiently reasoned. It did not enter into the complaint and imposed court costs of CHF 500 on the appellant.

Sumário Omnilex

Art. 42 Abs. 1 und 2 BGG; Art. 108 Abs. 1 lit. b BGG: A federal appeal must, in a factually and legally focused manner, engage with the decisive reasoning of the challenged decision and explain briefly wherein the violation of law lies. A mere repetition of previous submissions or omission of any discussion of the operative grounds of the cantonal decision is insufficient. Where the deficiency is manifest, the court may decline to enter in simplified procedure by single judge without ordering a response or further instructions (consid. 1). Costs are allocated according to the outcome under Art. 65 and Art. 66 BGG.

Urteil vom 7. Juli 2014

II. öffentlich-rechtliche Abteilung

Besetzung
Bundesrichter Zünd, Präsident,
Gerichtsschreiber Feller.

Verfahrensbeteiligte
A.________,
Beschwerdeführer,

gegen

Kanton Zürich, vertreten durch die Finanzdirektion, des Kantons Zürich, Walcheplatz 1, 8090 Zürich,
Beschwerdegegner.

Gegenstand
Forderung aus Staatshaftung; Nichteintreten wegen Nichtleistung des Kostenvorschusses,

Beschwerde gegen den Beschluss des Obergerichts des Kantons Zürich, I. Zivilkammer, vom 30. Mai 2014.

Erwägungen:

A.________ klagte am 24.

Whether the federal appeal met the reasoning requirements under Art. 42 BGG

Decisão extraída

No. The appeal did not engage with the decisive reasons of the cantonal non-entry decision and was therefore insufficiently reasoned.

Fundamentação extraída

An appeal must state in a concise manner how the challenged decision violates law and must address the reasoning that determined the outcome. Since the appellant ignored the cantonal court's key ground, namely the lack of an appeal brief challenging the district court's non-entry for non-payment of the advance, the complaint was manifestly inadequate.

Questão jurídica principal

Whether the federal court could enter into the appeal in simplified procedure under Art. 108 BGG

Decisão extraída

No. The deficiency was obvious, so non-entry by single judge in simplified procedure was appropriate.

Fundamentação extraída

Where a complaint is manifestly insufficiently reasoned, the court may decline to enter under Art. 108 Abs. 1 lit. b BGG without further exchanges or instructions.

Questão jurídica principal

Allocation of court costs

Decisão extraída

Court costs of CHF 500 were imposed on the appellant.

Fundamentação extraída

Costs follow the outcome under Art. 66 Abs. 1 BGG.
