The Federal Court discontinued the appeal after the bankruptcy office and creditors expressly waived continuation of the proceedings. It held that, in these circumstances, the appellate costs were not estate debts but ordinary bankruptcy claims and therefore had to be borne by the bankrupt appellant. No party compensation was awarded.

The procedural costs arising from the discontinued appeal do not constitute estate debts within the meaning of Art. 262 SchKG, but ordinary bankruptcy claims, and are to be charged to the bankrupt debtor. No party compensation is due absent continuation of the dispute.

In Erwägung,
dass das Handelsgericht des Kantons St. Gallen die von der Klägerin erhobene Klage mit Entscheid vom 6. April 2006 im Betrag von Fr. 48'750.-- nebst 5 % Zins seit 3. Oktober 2001 schützte und im Übrigen abwies;
dass die Klägerin diesen Entscheid am 24. Mai 2006 mit Berufung beim Bundesgericht anfocht mit den Anträgen, ihn aufzuheben, soweit die Klage nicht gutgeheissen wurde, und die Sache zur Fortsetzung des Verfahrens an die Vorinstanz zurückzuweisen;
dass am 6. Juli 2006 über die Klägerin der Konkurs eröffnet wurde;
dass das Konkursamt Nidwalden mit Verfügung vom 26. Juli 2006 aufgefordert wurde, innerhalb von zehn Tagen nach der zweiten Gläubigerversammlung oder (bei summarischem Verfahren) innerhalb von zwanzig Tagen nach Auflegung des Kollokationsplans dem Bundesgericht mitzuteilen, ob die Konkursmasse oder einzelne Gläubiger das Berufungsverfahren weiterführen wollen;
dass das Konkursamt Nidwalden als Konkursverwalterin dem Bundesgericht mit Schreiben vom 2. April 2008 mitteilte, dass sowohl die Konkursmasse der Klägerin als auch die Gläubiger auf eine Weiterführung des Prozesses verzichten;
dass angesichts des Verzichts der Konkursverwaltung auf eine Weiterführung des Berufungsverfahrens die Gerichtskosten keine Masseschuld (Art. 262 SchKG), sondern eine gewöhnliche Konkursforderung darstellen, und daher nicht zu Lasten der Konkursmasse, sondern der Konkursitin gehen;
verfügt der Präsident in Anwendung von Art. 5 Abs. 2 und Art. 73 Abs. 1 BZP in Verbindung mit Art. 40 OG:

Das Berufungsverfahren wird infolge Verzichts der Konkursverwaltung und der Gläubiger auf die Weiterführung des Prozesses abgeschrieben.

Die Gerichtskosten von Fr. 1'000.-- werden der Konkursitin auferlegt.
3.
Es wird keine Parteientschädigung zugesprochen.
4.
Diese Verfügung wird den Parteien und dem Handelsgericht des Kantons St. Gallen schriftlich mitgeteilt.

The appeal proceedings were struck off because the bankruptcy administration and the creditors declined to continue the proceedings.
In light of the waiver of continuation, the appeal had become pointless and had to be discontinued.
