In a civil dispute over a land-sale contract, the defendant appealed to the Federal Supreme Court against the Zurich cantonal appellate judgment of 28 July 2006. While that appeal was pending, the Zurich Cantonal Court of Cassation, by circular decision of 4 September 2007, set aside the appellate judgment and remanded the case for reconsideration. Since no federal challenge was brought against that cassation decision within the statutory period, the federal appeal lost its object and was struck off the roll. The court also charged the federal court fee of CHF 500 to the defendant.

Das Bundesgericht zieht in Erwägung:
Das Bundesgesetz über das Bundesgericht vom 17. Juni 2005 (BGG; SR 173.110) ist am 1. Januar 2007 in Kraft getreten (AS 2006 1205, 1243). Da der angefochtene Entscheid vorher ergangen ist, richtet sich das Verfahren noch nach dem OG (Art. 132 Abs. 1 BGG).

Das Obergericht des Kantons Zürich wies die von der Beklagten gegen den Entscheid des Bezirksgerichts Winterthur vom 4. August 2005 erhobene Berufung mit Urteil vom 28. Juli 2006 ab. Gegen dieses Urteil reichte die Beklagte Berufung beim Bundesgericht und kantonale Nichtigkeitsbeschwerde ein. Das Kassationsgericht des Kantons Zürich hiess die Nichtigkeitsbeschwerde mit Zirkulationsbeschluss vom 4. September 2007 gut, hob das Urteil des Obergerichts des Kantons Zürich vom 28. Juli 2006 auf und wies die Sache im Sinne der Erwägungen zur Neubeurteilung an die Vorinstanz zurück. Der Beschluss des Kassationsgerichts ist innerhalb der Beschwerdefrist von Art. 100 Abs. 1 BGG nicht mit Beschwerde beim Bundesgericht angefochten worden. Damit kann die beim Bundesgericht eingereichte Berufung als gegenstandslos geworden abgeschrieben werden. Die Gerichtsgebühr ist der Beklagten aufzuerlegen (Art. 156 Abs. 6 OG).

Demnach beschliesst das Bundesgericht:
1.
Die Berufung wird als gegenstandslos abgeschrieben.
2.
Die Gerichtsgebühr von Fr. 500.-- wird der Beklagten auferlegt.
3.
Dieser Beschluss wird den Parteien und dem Obergericht des Kantons Zürich, II. Zivilkammer, schriftlich mitgeteilt.
