The complainants withdrew their constitutional complaint against the Bern Higher Court’s decision of 4 August 2008. The Federal Supreme Court therefore struck the proceedings off the docket. It ordered the complainants to pay court costs of CHF 300 pursuant to Art. 66(3) BGG and notified the parties and the lower appellate court in writing.
Art. 32 Abs. 2 BGG; withdrawal of the complaint: when the appellant withdraws the appeal or constitutional complaint, the Federal Supreme Court strikes the proceedings off the docket without further substantive examination. Costs follow Art. 66 Abs. 3 BGG and are in principle borne by the withdrawing appellants.

dass die Gerichtskosten den Beschwerdeführern aufzuerlegen sind (Art. 66 Abs. 3 BGG);
verfügt das präsidierende Mitglied gemäss Art. 32 Abs. 2 BGG:

Das Verfahren wird infolge Rückzugs der Beschwerde abgeschrieben.
2.
Die Gerichtskosten von Fr. 300.-- werden den Beschwerdeführern auferlegt.
3.
Diese Verfügung wird den Parteien und dem Obergericht des Kantons Bern, Appellationshof, 1. Zivilkammer, schriftlich mitgeteilt.
