The appellant challenged a cantonal decision concerning a small monetary claim. The Federal Supreme Court held that an ordinary civil appeal was unavailable because the amount in dispute did not meet the statutory threshold and no question of fundamental importance was shown. Costs are borne by the unsuccessful complainant under Art. 66 Abs. 1 BGG.

In Erwägung,
dass die Gerichtspräsidentin 1 des Gerichtskreises III Aarberg-Büren-Erlach den Beschwerdeführer auf Klage des Beschwerdegegners mit Entscheid vom 4. November 2008 zur Zahlung von Fr. 295.-- nebst 5 % Zins seit 13. März 2007 verpflichtete;
dass der Beschwerdeführer diesen Entscheid mit Nichtigkeitsklage beim Obergericht des Kantons Bern anfocht und dieses mit Beschluss vom 15. Januar 2009 feststellte, dass die Nichtigkeitsklage mangels Zahlung des verlangten Gerichtskostenvorschusses dahingefallen sei, und das Nichtigkeitsklageverfahren als erledigt vom Protokoll abschrieb;
dass der Beschwerdeführer dem Bundesgericht eine vom 22. Januar 2009 datierte Eingabe einreichte, in der er erklärte, gegen den Beschluss des Obergerichts vom 15. Januar 2009 Beschwerde zu erheben;
dass die Beschwerde in Zivilsachen nach Art. 72 ff. BGG nicht erhoben werden kann, weil der erforderliche Mindeststreitwert von Fr. 30'000.-- (Art. 74 Abs. 1 lit. b BGG) nicht erreicht wird und sich keine Rechtsfrage von grundsätzlicher Bedeutung im Sinne von Art. 74 Abs. 2 lit. a BGG stellt;
dass die Eingabe des Beschwerdeführers unter diesen Umständen als subsidiäre Verfassungsbeschwerde im Sinne der Art. 113 ff. BGG behandelt werden muss;
dass mit einer solchen Beschwerde ausschliesslich die Verletzung von verfassungsmässigen Rechten gerügt werden kann (Art. 116 BGG);
dass in der Beschwerdeschrift dargelegt werden muss, welche verfassungsmässigen Rechte durch das kantonale Gericht verletzt worden sind, und solche Rügen unter Bezugnahme auf die Erwägungen des angefochtenen Entscheides zu begründen sind (Art. 42 Abs. 2 und Art. 106 Abs. 2 in Verbindung mit Art. 117 BGG);
dass in der Beschwerdeschrift zwar behauptet wird, der angefochtene Entscheid verstosse gegen verfassungsrechtliche Garantien, diese Behauptungen aber pauschal formuliert sind und deshalb nicht erkennen lassen, inwiefern der Beschluss des Obergerichts verfassungsmässige Rechte des Beschwerdeführers verletzen soll;
dass damit auf die Beschwerde mangels hinreichender Begründung nicht einzutreten ist (Art. 108 Abs. 1 lit. b BGG);
dass die Gerichtskosten dem Beschwerdeführer aufzuerlegen sind (Art. 66 Abs. 1 BGG);
erkennt die Präsidentin:

Auf die Beschwerde wird nicht eingetreten.
2.
Die Gerichtskosten von Fr. 300.-- werden dem Beschwerdeführer auferlegt.

Dieses Urteil wird den Parteien und dem Obergericht des Kantons Bern, Appellationshof, 2. Zivilkammer, schriftlich mitgeteilt.
