Resumo Omnilex

The applicant sought revision of an earlier Federal Supreme Court judgment that had rejected his complaint without entering into the merits. He argued that the Court had wrongly refused to hear the complaint and accused Judge Corboz of abuse of office, also requesting his recusal. The Court held that these submissions did not disclose any revision ground under Art. 121 lit. c or d BGG, and that the abuse-of-office allegation was manifestly unfounded under Art. 123 Abs. 1 BGG. The recusal request was moot because Corboz did not take part in the revision proceedings. The revision was dismissed and no court costs were charged.

Sumário Omnilex

Art. 121 lit. c, d BGG; Art. 123 Abs. 1 BGG; revision of a federal judgment is unavailable where the applicant merely reargues that the original complaint should have been entered into, since isolated party submissions do not constitute motions within the meaning of Art. 121 lit. c BGG. A revision ground under Art. 123 Abs. 1 BGG requires a substantiated, objectively tenable allegation of criminal conduct or comparable misconduct; a plainly unsupported accusation is insufficient. A recusal request is moot if the challenged judge does not participate in the revision proceedings. Art. 66 Abs. 1 BGG permits waiver of court costs in the circumstances of the case.

Urteil vom 8. Dezember 2008
I. zivilrechtliche Abteilung

Besetzung
Bundesrichterin Klett, präsidierendes Mitglied,
Bundesrichterinnen Rottenberg Liatowitsch, Kiss,
Gerichtsschreiber Huguenin.

Parteien
A.________,
Gesuchsteller,

gegen

X.________,
Gesuchsgegnerin,
vertreten durch Rechtsanwalt Patrik Eisenhut.

Gegenstand
Revision des bundesgerichtlichen Urteils
vom 27. Oktober 2008 (4A_476/2008).

In Erwägung,
dass das Bundesgericht mit Urteil vom 27. Oktober 2008 auf eine vom Gesuchsteller gegen das Urteil des Kantonsgerichts Freiburg vom 27. August 2008 erhobene Beschwerde in Anwendung von Art. 108 Abs. 1 lit. b BGG nicht eintrat, weil die Beschwerdeschrift keine den gesetzlichen Anforderungen genügende Begründung enthielt;
dass der Gesuchsteller dem Bundesgericht eine vom 20. Oktober 2008 datierte, aber am 1. Dezember 2008 der Post übergebene Eingabe einreichte, in der er erklärte, gegen das Urteil des Bundesgerichts vom 27. Oktober 2008 Revision einzulegen;
dass in dieser Eingabe zur Begründung des Revisionsgesuchs ausgeführt wurde, dass das Bundesgericht auf die Beschwerde zu Unrecht nicht eingetreten sei und der am Verfahren mitwirkende Präsident Corboz, gegen den für das Revisionsverfahren ein Ausstandsbegehren gestellt werde, Amtsmissbrauch begangen habe;
dass das Ausstandsbegehren gegen Präsident Corboz gegenstandslos ist, weil dieser am Revisionsverfahren nicht mitwirkt;
dass nach der Praxis des Bundesgerichts einzelne Vorbringen der Parteien keine Anträge im Sinne von Art. 121 lit. c BGG bilden und nicht mittels Revision geltend gemacht werden kann, dass das Bundesgericht auf die Beschwerde hätte eintreten müssen, weil die vorgebrachten Rügen den Begründungsanforderungen genügt hätten (Urteil 7B.68/2001 E. 2 vom 30. März 2001 und Urteil 4F_1/2007 E. 5 vom 13. März 2007);
dass somit die sinngemässe Behauptung des Vorliegens eines Revisionsgrundes im Sinne von Art. 121 lit. c oder d BGG offensichtlich unbegründet ist;
dass der vom Gesuchsteller gegenüber Präsident Corboz erhobene Vorwurf des Amtsmissbrauchs offensichtlich haltlos ist, weshalb der sinngemäss behauptete Revisionsgrund von Art. 123 Abs. 1 BGG nicht gegeben ist;
dass aus diesen Gründen das Revisionsgesuch abzuweisen ist;
dass unter den gegebenen Umständen auf die Erhebung von Gerichtskosten zu verzichten ist (Art. 66 Abs. 1 BGG);
erkennt das Bundesgericht:

1.
Das Revisionsgesuch wird abgewiesen.

2.
Es werden keine Gerichtskosten erhoben.

3.
Dieses Urteil wird den Parteien und dem Kantonsgericht Freiburg, II. Zivilappellationshof, schriftlich mitgeteilt.

Questão jurídica principal

Whether the request for revision based on Art. 121 lit. c or d BGG was well founded

Decisão extraída

No revision ground under Art. 121 lit. c or d BGG was shown; the applicant merely repeated arguments that the Court should have entered into the original complaint.

Fundamentação extraída

Under Federal Supreme Court practice, isolated submissions by a party do not constitute motions within the meaning of Art. 121 lit. c BGG and cannot be used to assert that the Court should have admitted the complaint.

Questão jurídica principal

Whether the alleged abuse of office by Judge Corboz justified revision under Art. 123 Abs. 1 BGG

Decisão extraída

The accusation was manifestly unfounded and did not establish any revision ground.

Fundamentação extraída

The raised allegation against Judge Corboz was clearly untenable; moreover, the recusal request was moot because he did not participate in the revision proceedings.

Questão jurídica principal

Whether court costs should be charged

Decisão extraída

No court costs were imposed in the circumstances.

Fundamentação extraída

Given the circumstances of the case, the Court waived the imposition of costs under Art. 66 Abs. 1 BGG.
