Resumo Omnilex

The spouses A. brought a public-law appeal and a reform appeal against the same judgment of the Geneva Civil Chamber. On the same day, the Federal Court partly allowed the reform appeal, annulled the cantonal judgment, and remitted the matter. As a result, the public-law appeal had become moot. The Federal Court struck the case from the roll and, considering that the appellants had used an unnecessary remedy, ordered them jointly and severally to pay the court fee and the respondent's legal costs.

Sumário Omnilex

Art. 40 OJ; art. 72 PCF; art. 156 al. 6 OJ; art. 159 al. 5 OJ: becomes moot a public-law appeal lodged against the same cantonal judgment when, in a parallel reform appeal, the Federal Court annuls the challenged judgment and remits the case to the cantonal court. In such a situation, the Federal Court strikes the matter from the roll and allocates costs according to the pre-existing state of affairs; a party that pursued an unnecessary remedy may be ordered to bear the court fee and the adverse party's costs, jointly and severally if appropriate (consid. 1).

Que les recourants ont saisi le Tribunal fédéral d'un recours de droit public et d'un recours en réforme dirigés contre le même prononcé;
Que par arrêt de ce jour, le Tribunal fédéral a partiellement admis le recours en réforme, annulé l'arrêt attaqué et renvoyé la cause à la juridiction cantonale;
Que le recours de droit public est ainsi devenu sans objet;
Qu'en pareille situation, le Tribunal fédéral raye la cause du rôle et statue sur les frais et dépens en tenant compte de l'état de choses existant avant la circonstance qui met fin au litige (art. 40 OJ, 72 PCF);
Que les recourants ont usé d'une voie de recours inutile;
