The Federal Supreme Court noted the appellant's withdrawal of the appeal against the Vaud cantonal civil judgment and removed the case from the docket. Under Art. 5 para. 2 PCF by analogy via Art. 71 LTF and Art. 66 paras. 1 and 2 LTF, the judicial costs are borne by the withdrawing appellant, unless special circumstances justify a different allocation.

Whether the withdrawn appeal should be struck from the docket
The Court took note of the withdrawal and removed the case from the docket.
Once the appellant declared withdrawal, the proceedings no longer had to be continued; the court merely recorded the withdrawal and struck the case.
