The appellant withdrew his civil appeal against the Geneva Court of Justice's order in a seizure matter. The Federal Supreme Court took note of the withdrawal and struck the case from the docket. Whether the withdrawn appeal should be struck from the docket
The court took note of the withdrawal and ordered the case struck from the docket.
After the appellant's declaration withdrawing the appeal, there was no need to decide the merits; the case had to be removed from the docket under the cited procedural provisions.
Allocation of court costs after withdrawal of the appeal
A judicial fee of CHF 1,000 was imposed on the appellant.
Because the appeal was withdrawn, the court charged the judicial fee to the appellant pursuant to the cited cost rules.
