Resumo Omnilex

X.________ filed a subsidiary constitutional complaint against a Basel-Landschaft cantonal court decision that had not entered on her appeal because the CHF 150 cost advance had not been paid. The Federal Supreme Court held that only the subsidiary constitutional complaint was available, but the filing was largely inadmissible: it sought restoration of a cantonal deadline beyond the Federal Supreme Court’s competence, raised issues not covered by the cantonal decision, and did not meet the strict constitutional reasoning requirements. The complaint was also deemed abusive. Legal aid was refused and CHF 100 in costs were imposed.

Sumário Omnilex

Art. 113 ff., 116, 117 and 108 BGG; Art. 64 and 66 BGG; requirements of the subsidiary constitutional complaint. A subsidiary constitutional complaint is limited to violations of constitutional rights; the complaint must, in a clear and detailed manner and by reference to the cantonal reasoning, state which constitutional rights were infringed and how. Arguments outside the scope of the contested decision are inadmissible. Requests for restoration of cantonal deadlines fall within the competence of the cantonal authority, not the Federal Supreme Court. Where the complaint is manifestly inadmissible, insufficiently reasoned or abusive, non-entry follows in simplified proceedings; hopeless proceedings do not justify legal aid, and costs are borne by the losing party.

Urteil vom 9. Januar 2013
II. zivilrechtliche Abteilung

Besetzung
Bundesrichterin Escher, präsidierendes Mitglied, Gerichtsschreiber Füllemann.

Verfahrensbeteiligte
X.________,
Beschwerdeführerin,

gegen

Kanton Basel-Landschaft,
vertreten durch das Kantonsgericht, Justizverwaltung, Kosteneinzug, Bahnhofplatz 16, Postfach 635,
4410 Liestal,
Beschwerdegegner.

Gegenstand

in Erwägung,

Admissibility of the constitutional complaint despite low amount in dispute

Decisão extraída

Only subsidiary constitutional complaint was available because the amount in dispute did not reach the statutory threshold and no exception applied.

The underlying cantonal decision was a pecuniary matter below the Federal Supreme Court’s value threshold, so ordinary appeal remedies were unavailable.

Questão jurídica principal

Request to restore the cantonal time limit for the cost advance

Decisão extraída

The request could not be examined by the Federal Supreme Court.

Fundamentação extraída

A request under Art. 148 CPC must be decided by the cantonal court, not by the Federal Supreme Court.

Such complaints were inadmissible.

Fundamentação extraída

Only issues forming part of the appealed decision can be reviewed in this proceeding.

Questão jurídica principal

Decisão extraída

The complaint lacked the required clear and detailed constitutional reasoning.

The complaint was hopeless and therefore did not satisfy the conditions for legal aid.
