The Federal Supreme Court noted that its Civil Division had already set aside the cantonal judgment in a simultaneously decided ordinary appeal. As a result, the constitutional complaint against the same judgment no longer had an object and was struck out as moot. The court nevertheless charged the appellant with a court fee of CHF 500 under Art. 156 Abs. 6 OG. The respondents were not awarded compensation because no written response had been ordered in the constitutional complaint proceedings.
Art. 156 Abs. 6 OG; mootness of a constitutional complaint after the challenged judgment has been annulled in parallel proceedings. If, in a concurrent appeal, the Federal Supreme Court sets aside the cantonal decision attacked by constitutional complaint, the latter loses its object and is struck out as moot. In such a constellation, costs may nevertheless be imposed on the appellant under Art. 156 Abs. 6 OG. No party compensation is due where no response was solicited from the respondents.

in das Urteil der erkennenden Abteilung des Bundesgerichts in der Sache 5C.27/2006 vom heutigen Tag,
in Erwägung,
dass die erkennende Abteilung des Bundesgerichts mit Urteil vom heutigen Tag das mit staatsrechtlicher Beschwerde angefochtene Urteil in Gutheissung der gleichzeitig eingereichten Berufung des Beschwerdeführers aufgehoben hat,
dass die vorliegende staatsrechtliche Beschwerde damit als gegenstandslos abzuschreiben ist,
dass die Kosten des Verfahrens in Anwendung von Art. 156 Abs. 6 OG dem Beschwerdeführer aufzuerlegen sind,
dass der Beschwerdeführer die Beschwerdegegner für das bundesgerichtliche Verfahren nicht zu entschädigen hat, da im Verfahren der staatsrechtlichen Beschwerde keine Vernehmlassung eingeholt worden ist,
beschlossen:
1.
Die staatsrechtliche Beschwerde wird als gegenstandslos abgeschrieben.
2.
Die Gerichtsgebühr von Fr. 500.-- wird dem Beschwerdeführer auferlegt.
3.
Dieser Beschluss wird den Parteien und dem Obergericht des Kantons Aargau, Zivilgericht, 2. Kammer, schriftlich mitgeteilt.

Whether the constitutional complaint still had a live object after the parallel federal judgment
The complaint had become moot and was struck out.
Because the same cantonal judgment had already been set aside in the concurrently decided ordinary appeal, there was no remaining object for the constitutional complaint.
How to allocate the costs of the moot constitutional complaint
The court fee was charged to the appellant.
Under Art. 156 Abs. 6 OG, costs were imposed on the appellant despite mootness; no compensation was due because no response had been invited from the respondents.
